Information pursuant to Articles 26 and 28 of
the Data Act

Information provided by RX-WATERTEC GmbH, Kreativpark Karlsruhe, Alter Schlachthof 47, 76131 Karlsruhe, Germany, pursuant to Articles 26 and 28 of Regulation (EU) 2023/2854 (the “Data Act”) regarding the data processing service VUE.RX

1. Switching Providers and Data Portability (Art. 26 of the Data Act)
Customers of VUE.RX may switch to another provider or transfer their data to their own ICT infrastructure at any time. Details are governed by the General Terms and Conditions (Part B, Section IV, § 8) and Annex 1 thereto.

Available Transfer Methods:

• Complete data export on request: Upon request to support@rx-watertec.com, RX-WATERTEC shall promptly generate a complete export of all exportable data (normalized and stored measurement values, master and configuration data) – free of charge.
• MQTT data interface: Continuous, machine-readable retrieval of current measurement data via the MQTT broker provided by RX-WATERTEC (TLS), including for direct transfer to a new provider – free of charge.
• Self-service export: Export of historical measurement data, alarms and reports directly within the VUE.RX portal.
• Assisted migration: Support with export and migration to the extent described in the General Terms and Conditions.

   

Available Data Formats:

JSON (RFC 8259), CSV (RFC 4180), Excel; location data as GeoJSON (RFC 7946, WGS84); timestamps in accordance with ISO 8601 (UTC); real-time provision via MQTT 3.1.1/5.0 (OASIS standard); reports as PDF.

Known Limitations:

• Historical measurement data is available within the contractually agreed retention period; data predating this period is no longer available.
• Data processed exclusively within third-party environments (e.g., radio network operators) is subject to the export and format limitations of those third parties.
• Large-scale exports may be staggered over time or provided in partial deliveries in order to safeguard platform operations.
• Import into the target environment depends on that environment’s technical capabilities and data model; RX-WATERTEC bears no responsibility in this regard.

Detailed technical documentation of the interfaces (including MQTT connection data, topic structure and payload schemas) is made available by RX-WATERTEC to its customers in the VUE.RX platform documentation. This register is updated whenever interfaces or formats change.

3. Jurisdiction of the ICT Infrastructure (Art. 28 of the Data Act)

The ICT infrastructure used for VUE.RX is operated in Amazon Web Services data centers in the Frankfurt am Main region (Germany), including backups within the EU. The relevant jurisdiction with respect to the infrastructure used is the Federal Republic of Germany; the law of the European Union and its Member States applies.

4. Measures Against Unlawful International Governmental Access
(Art. 28 of the Data Act)

RX-WATERTEC has implemented the following technical, organizational and contractual measures to prevent international governmental access to, or transfer of, non-personal data stored in the EU where such access would conflict with Union law or the law of the Member State concerned:

• Technical measures: Hosting exclusively in data centers within the EU (AWS Frankfurt region); logical separation of customer environments; encryption of data in transit and at rest; restrictive, logged access controls based on the need-to-know principle.
• Organizational measures: An internal process for handling requests from public authorities: review of the legal basis, assessment of compatibility with Union law and the law of the Member State concerned, and challenging of requests that violate such law or exceed the requesting authority’s powers.
• Contractual measures: Contractual obligations imposed on hosting and infrastructure providers to comply with applicable EU law and, to the extent legally permissible, to provide information about governmental access requests; Standard Contractual Clauses (SCCs), where applicable.
• Transparency: Unless legally prohibited from doing so, RX-WATERTEC shall promptly inform affected customers of any such request and the data concerned.
